BOARD OF ADJUSTMENT MEETING
JANUARY 9, 2001

The Chairman appointed Mr. Gattinella to replace Mr. Doyle and Mr. Pellegrini to act as secretary and replace Mr. O'Loughlin for this meeting.

CASE NO. 25-R-17500 (55-2000)
Off Fletcher Road
An appeal from an Administrative Decision under RSA 674:41 and a variance is requested from sections 702 + 501 to permit the construction of a single family dwelling on a lot having no frontage on a town approved road where 175' lot frontage is required.

Mr. Pellegrini read the case and a letter from the Windham Fire Department into the record. Mr. George Fredette, representing the Applicant, presented the case. Mr. Fredette stated that this is a 12 acre parcel and the closest public right-of-way is Marblehead Road. Fletcher Estates, an approved development, will have two cul-de-sacs, one of which will be only 800 feet from the Higgins property line. A 15 foot wide driveway will be installed on the Higgins property. Mr. Fredette listed the concerns of the Fire Department:

  1. A fire truck could go over the surface of the driveway.
  2. What grade the surface of the driveway would be.
  3. A way to turn around.


Mr. Fredette said that 12 feet of the 15 foot wide driveway would be paved and the grade would be a maximum of 8% and the driveway will have a 100 foot diameter circle for vehicles to turn around. This driveway would be 800 feet in length. Mrs. Crisler, member of the Windham Planning Board, explained that there was no intent by the Planning Board to deprive access to the Higgins property. Although the Planning Board pulled back access (Corliss Drive), access was restored in May. Mr. Fredette read the five supporting facts into the record. Mr. Gattinella stated that if Fletcher Road is a Class 5 Highway the Applicant does not need a variance. Mrs. Crisler stated that this is an approved subdivision and Fletcher Road is Class 5. Mr. Gattinella went on to say that in order to hear the Appeal from an Administrative Decision under RSA 674:41, the Code Enforcement Officer, Mr. Bruce Flanders, must be in attendance. Therefore, Mr. Gattinella thought it would be best to grant a continuance. Mr. Gattinella made a motion to continue this case to the January 23, 2001 meeting. Mr. Breton seconded the motion. Passed unanimously.

MINUTES
Mr. Drummond made a motion to accept the amended minutes from the November 28, 2000 meeting. Mr. Breton seconded the motion. Passed unanimously.

OTHER BUSINESS
The Members reviewed the new forms and made changes and corrections. The Members discussed requiring certified plot plans. The Members will question Mr. Flanders at the next meeting regarding certified plot plans. Mr. Gattinella suggested that the forms be renumbered in order to have them in sequence. The Board instructed Mrs. Kovolyan that until the new forms have been approved be sure to change all old forms from 20 to 30 days from date of notice.

The Members discussed the Selectmen's amendment to the zoning ordinance regarding Cemetery Setback Requirements concerning Special Exemption. Mr. Gattinella pointed out discrepancies and inconsistencies. Mr. Pellegrini made a motion to allow Mr. Gattinella to speak for the Zoning Board Members at the January 10, 2001 Planning Board Meeting regarding the Cemetery Setback Requirments. Mr. Breton seconded the motion. Mr. Gustafson requested that a memo be typed to the Planning Board indicating that Mr. Gattinella has permission to represent the Zoning Board.

Mr. Pellegrini made a motion to adjourn at 9:38 PM. Mr. Drummond seconded the motion. Passed unanimously.

The next meeting of the Zoning Board of Adjustment will be on January 23, 2001 at 7:30 PM at the Windham Town Hall.
