Mr. Hohenberger and Ms. Prendergast replaced Mrs. Crisler and Mr. Morris respectively.
Mr. Carpenter opened the meeting at 7:15 pm.
PUBLIC HEARING:
CIP Presentation
Ms. Linowes presented the revised CIP for 2002. Mr. McLeod made a motion to accept the final CIP plan presented 12/12/01 (dated 12/6/01) and send on to the Board of Selectmen. Seconded by Mr. Wilder. Passed 6-0-1. Mr. Hohenberger abstained.
Zoning Amendments
Citizen Petition
Amendment #1 Mr. McLeod read the proposed amendment. Ms. Elizabeth Marston, 18 Wilson Road, presented the purpose of the amendment. The Chairman read a letter from Attorney Donovan and the Board discussed the amendment. Public comment began with Mr. Bob Leonard, 88 Meetinghouse Road; Mr. Kevin Waterhouse, 175 Haverhill Road; and Mr. Walter Colbert, 10 Aladdin Road. The Chairman read two petition amendments into the record. Public comment continued with Ms. Marston and Mr. Waterhouse. The Chairman read a letter from Al Turner responding to Attorney Donovans letter.
Planning Board Zoning Amendments
Amendment #1 Mr. McLeod read the amendment, and Mr. Turner presented the amendment on the display map. Mr. McLeod made a motion to recommend Amendment #1 to Warrant with Planning Board approval. Seconded by Mr. Wilder. Passed 6-0.
Amendment #2 Mr. McLeod read the amendment. Public comment by Mr. Norman Babineall, 188 Rockingham Road, asked about taxes. This amendment will be revised and reposted for the 2nd public hearing on zoning amendments on January 9, 2002.
Amendment #3 Mr. McLeod read the amendment, and Mr. Turner presented the amendment on the display map. No public input. Mr. Wilder made a motion to recommend #3 to Warrant with Planning Board approval. Seconded by Mr. Hohenberger. Passed 6-0.
Amendment #4 Mr. McLeod read the amendment, and Mr. Turner presented the amendment. Public comment by Mr. Jack Gattinella, Golden Brook Road, regarding the delineating the southern portion. This amendment will be revised and reposted for the 2nd public hearing on zoning amendments on January 9, 2002.
Amendment #5 Mr. McLeod read the amendment, and Mr. Turner described the amendment. Public comment by Ms. Darlene Hosfield, 128 Rockingham Road, concerned about property values; Ms. Theresa Steele, 126 Rockingham Road; and Mr. Bruce Richardson, 33 Armstrong Road. The Board discussed the amendment. Mr. Wilder made a motion to recommend Amendment #5 to Warrant with Planning Board approval with the following changes: 1) remove 2499 and 2500; 2) put in a separate amendment for 2499 and 2500 to Neighborhood Business District; and 3) put in a more detailed delineation of the lot lines. Seconded by Mr. Kolodziej. Passed 6-0.
Amendment #6 Mr. McLeod read the amendment, and Mr. Turner described the amendment. No public comment. Mr. Wilder made a motion to recommend Amendment #6 for Warrant with Planning Board approval. Seconded by Mr. McLeod. Passed 5-0.
Amendment #7 Mr. McLeod read the amendment, and Mr. Turner described the amendment. The Board discussed a rewrite by breakdown of lots. Public comment by Mr. Richardson; Mr. Dennis Tremblay, 76 Turtle Rock Road; and Mr. Colbert. The Board discussed the amendment. This amendment will be revised and reposted for the 2nd public hearing on zoning amendments on January 9, 2002.
Amendment #8 Mr. McLeod read the amendment, and Mr. Twarog presented the amendment. Public comment by Mrs. Janice Root, 36 Harris Road, stated her concerns about frontage and property values. Mr. Hohenberger made a motion to recommend Amendment #8 to Warrant with Planning Board approval. Seconded by Ms. Prendergast. Passed 5-0.
Amendment #9 Mr. McLeod read the amendment, and Mr. Turner presented the amendment with proposed revision. No public comment. This amendment will be revised and reposted for the 2nd public hearing on zoning amendments on January 9, 2002.

Amendment #11 Mr. McLeod read the amendment. Public comment by Mr. Wayne Bailey, 3 Heron Cove and 1-3 Colonial Drive; and Mr. Gattinella. Mr. McLeod made a motion to recommend Amendment #11 to Warrant with Planning Board approval with through the WWPD at the end of 601.3.8C and change the wording before landing instead of after the word fishing in 601.3.7. Seconded by Mr. Kolodziej. Passed 5-0.
Amendment #12 Mr. McLeod read the amendment, and Mr. Turner presented the amendment. Public comment by Mr. Bailey and Mr. Gattinella. Mr. Carpenter made a motion to recommend Amendment #12 to Warrant with Planning Board approval. Passed 5-0.

Mr. McLeod made a motion to recommend Amendment #29 to Warrant with Planning Board approval with the following change to 615.6.2 to shall be 50 feet which shall be left wooded removing the 75 feet from the ordinance. Seconded by Mr. Kolodziej. Passed 5-0.
Amendment #30 Mr. McLeod read the amendment. No public comment. Mr. McLeod made a motion to remove Amendment #30 from further discussion. Seconded by Ms. Prendergast.
Amendment #31 Mr. Carpenter read the amendment. No public comment. Mr. McLeod made a motion to recommend Amendment #31 to Warrant with Planning Board approval. Seconded by Ms. Prendergast. Passed 4-1. Mr. Kolodziej opposed.
